1. This document ("Terms") tells you who we are, the recruitment services which we provide and other important information. Please read these Terms carefully before you register with us. If you think that there is a mistake in these Terms, please contact us to discuss. By completing and submitting a registration form you will be deemed to have accepted these Terms.
2. We are Teachers To Your Home Ltd ("we", "us", "our" or "the Company"). We are a company registered in England and Wales under company registration number 09204189. Our registered office is at 8 King Edward Street, Oxford, OX1 4HL. Our registered VAT number is 306567694.

4. If we have to contact you, we will do so by telephone, SMS text or by writing to you at the email address or postal address you provided when you registered with us.
What we will do
5. We are an employment agency as defined in section 13(2) of the Employment Agencies Act 1973. We provide work-finding services by introducing tutors to parents/legal guardians/clients ("Family") with a view to the tutor providing tuition to a child/student/adult learner ("Tuition Work").
6. You wish us to seek Tuition Work on your behalf ("Services"). The type of Tuition Work which you wish us to seek for you (including the subject and education stage) will be as set out in the registration form which you complete upon registering with us.
7. In order to provide these Services to you, we will have to process your personal data. In doing so we will comply at all times with our Privacy Notice which you can access here at https://www.teacherstoyourhome.com/uk/privacy-policy.
8. You agree that if potentially suitable Tuition Work becomes available, we have your permission to forward your academic profile, CV, any references which we obtain relating to you, and the information which you provided on your registration form, to the Family.
9. You acknowledge that we are under no obligation to shortlist you for any available Tuition Work.
What you will do
10. You agree that where the Tuition Work will involve you working with a minor or other vulnerable person (defined as someone who by reason of age, infirmity, illness, disability or any other circumstances is in need of care or attention), you will provide us with the names of two people who are not related to you whom we may contact to obtain a reference (or you will provide us with copies of references from two such people) and you will provide us with copies of any relevant qualifications. You acknowledge that we will offer to provide copies of those qualifications and references to the Family.
Contractual relationship and fees
11. You are a self-employed tutor and nothing in these Terms shall render you an employee, worker, agent or partner of ours and you shall not hold yourself out as such. You accept that if you carry out Tuition Work for a Family, you will be engaged directly by the Family to provide the Tuition Work on a one-to-one or group tuition basis on a frequency to be agreed by you and the Family (each attendance being a "Lesson"). You do not have the authority to bind the Company in any way.
12. You are responsible for co-ordinating the Lessons with the Family and any background information which you require in order to deliver the Lessons must be obtained by you directly from the Family or the student.
13. Provision of teaching and learning resources used in the Lessons will be provided directly by you to the Family. No teaching or learning resources are provided by us.
14. You are responsible for any costs associated with delivering the Lessons, including any travel expenses (unless you agree otherwise with the Family). We will not bear or reimburse any such costs or expenses.
15. The tuition fee per hour ("Tuition Fee") is agreed by you and the Family in advance of the Lesson. You can decide your own range of Tuition Fees which you are prepared to accept. When notifying you of potentially suitable Tuition Work we will tell you the Tuition Fee which the Family is prepared to pay and you acknowledge that by asking us to introduce you to the Family you are prepared to accept that Tuition Fee.
16. You will complete a timesheet (via our website) following completion of each Lesson for the Family to approve. This timesheet will detail the Lessons taught by you.
17. We will not charge you any fee for our Services. We will charge a fee to the Family (the "Platform Fee") equal to one third (33.3333%) of the Tuition Fee charged by you for each Lesson.
18. When you complete a timesheet on our website you will be able to create an invoice for your Tuition Fees which is payable by the relevant Family. Following the Family's approval of the timesheet, we will forward your invoice for your Tuition Fee (together with our invoice for our Platform Fee) to the relevant Family.
19. We recommend the use of a payment system called Stripe Payments Europe Ltd ("Stripe") (the "System") which allows Families to pay our Platform Fee and your Tuition Fee at the same time. We are not responsible in any way for provision of the System and your use of the System is subject to the terms and conditions of agreement provided by Stripe. If a Family pays for a Lesson via the System, your Tuition Fee will be sent directly to you if you have registered with Stripe and linked the System with your personal bank account.
20. Our Families generally make payment of invoices through the System in accordance with the terms agreed with the System provider. If you do not wish to use the System please inform us and you will need to agree an alternative means of payment with the Family and we will need to agree an alternative means of payment of our Platform Fee by the Family.
21. The relevant Family will be liable for payment of all Tuition Fees directly to you and we will not receive payment of the Tuition Fee on your behalf or be responsible for paying you.
22. You will be fully responsible for and shall indemnify us for and in respect of:
a. any income tax, National Insurance and social security contributions and any other liability, deduction, contribution, assessment or claim ("Tax") arising from or made in connection with the Tuition Fee, where the recovery is not prohibited by law. You shall further indemnify us against all reasonable costs, expenses and any penalty, fine or interest incurred or payable by us in connection with or in consequence of any such Tax; and
b. any liability arising from any employment-related claim or any claim based on worker status (including reasonable costs and expenses) brought by you against us arising out of or in connection with our provision of the Services and/or your delivery of the Lessons, except where such claim is as a result of any act or omission by us.
23. You acknowledge that we offer Families a "first lesson guarantee". If a Family is unhappy with your first Lesson, you agree that you will not charge the Family a Tuition Fee and we agree not to charge the Family a Platform Fee for that Lesson.
24. Cancellation of a Lesson - We recommend that you give "reasonable" notice to a Family if a Lesson needs to be cancelled. We also recommend the same "reasonableness" if the Family needs to cancel at the last minute. To do this, we encourage both parties to discuss and agree what is reasonable notice for them in the initial meeting. We also recommend agreeing a clear process for communicating any cancellations, e.g. sending a text or phone call etc.
25. Our suggested cancellation guidelines are:
There may be extenuating circumstances e.g. illness or emergencies which may override this.
26. If you wish to terminate your engagement with a Family, you should contact them directly and we would ask that you also let us know.
27. These Terms are governed by English law and you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.
28. These Terms are governed by the law of England & Wales and are subject to the exclusive jurisdiction of the Courts of England & Wales. Acceptance of terms
